Terms of Service

1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and Global InTech AS, a Norwegian company ("Company", "we", "us", or "our"), governing your access to and use of the kultur.dev Cultural Intelligence API and related services ("Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, do not use our Services.
2. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of Norway, without regard to conflict of law principles. Any disputes arising from or relating to these Terms or our Services shall be subject to the exclusive jurisdiction of the courts of Oslo, Norway. For consumers within the EU/EEA, this does not affect your statutory rights under mandatory consumer protection laws of your country of residence.
3. Description of Services
kultur.dev provides a Cultural Intelligence API that enables developers to access cultural insights, analyze content for cultural appropriateness, and receive guidance for culturally-aware content across global markets. The Services are provided via a RESTful API interface with tiered subscription plans.
4. Account Registration and Security
To use our Services, you must:
- Create an account with accurate, complete, and current information
- Be at least 18 years old or have legal authority to enter into binding agreements
- Maintain the confidentiality and security of your API keys and account credentials
- Immediately notify us of any unauthorized use of your account
- Accept responsibility for all activities that occur under your account
You may not share, transfer, or sell your API credentials to third parties without our written consent.
5. API Usage and Rate Limits
Your use of the API is subject to the following terms:
Rate Limits by Plan
- Free Tier: 1,000 credits/month, 10 requests/minute
- Pro ($99/month): 50,000 credits/month, 100 requests/minute
- Enterprise ($499/month): 500,000 credits/month, 1,000 requests/minute
Exceeding rate limits may result in temporary suspension or throttling. We reserve the right to modify rate limits with 30 days notice.
6. Credit Allocation and Expiration
- API credits are allocated at the start of each billing period
- Unused credits do not roll over to subsequent periods and expire at the end of each billing cycle
- Credits are non-transferable and have no cash value
- Overage charges may apply for usage exceeding your plan allocation (Pro and Enterprise only)
7. Prohibited Uses
You agree NOT to use our Services to:
- Violate any applicable laws, regulations, or third-party rights
- Generate, distribute, or facilitate illegal, harmful, discriminatory, or hateful content
- Attempt to reverse engineer, decompile, disassemble, or extract our proprietary models, algorithms, or knowledge base
- Circumvent, disable, or interfere with rate limits, security features, or access controls
- Scrape, harvest, or systematically extract data from our Services for competitive purposes
- Resell, sublicense, or redistribute our Services without express written authorization
- Impersonate any person or entity or misrepresent your affiliation
- Interfere with or disrupt the integrity or performance of our Services
- Use automated systems (bots, scrapers) except through the official API
8. Pricing and Payment
Subscription Plans:
- Free: $0/month — 1,000 credits/month, community support
- Pro: $99/month — 50,000 credits/month, priority email support, PDF reports
- Enterprise: $499/month — 500,000 credits/month, dedicated support + SLA
Payment Terms:
- Pro and Enterprise subscriptions are billed monthly in advance via Stripe
- All fees are exclusive of applicable taxes (VAT, sales tax)
- Failed payment may result in service suspension
- We reserve the right to change pricing with 30 days notice
Refunds: Subscription fees are generally non-refundable, except as required by Norwegian consumer protection law or where we have materially breached these Terms.
9. Service Level Commitment
Availability Target:
- Free Tier: Best-effort availability, no SLA
- Pro: 99.5% monthly uptime target
- Enterprise: 99.9% monthly uptime with SLA credits as specified in your agreement
Response Time Targets:
- Simple queries: Under 5 seconds (95th percentile)
- Complex multi-market queries: Under 15 seconds (95th percentile)
Support Response:
- Free: Community support only
- Pro: Email support with 24-hour response target
- Enterprise: Priority support with 4-hour response for critical issues
10. Intellectual Property
Our Property: The Services, including our cultural knowledge base, AI models, software, documentation, trademarks, and all related intellectual property, are owned by Global InTech AS and protected by Norwegian and international intellectual property laws.
Your Content: You retain ownership of content you submit to our API. By using our Services, you grant us a limited, non-exclusive license to process your content solely to provide the Services. We do not use your content to train our models.
Output: You own the outputs generated by the API in response to your queries, subject to these Terms.
11. Data Processing
Our processing of personal data is governed by our Privacy Policy and complies with the EU General Data Protection Regulation (GDPR) and Norwegian data protection laws. Content submitted via the API is processed transiently for analysis and is not stored permanently or used to train our models.
12. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE SPECIFICALLY DISCLAIM ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUR CULTURAL INSIGHTS ARE COMPLETE, ACCURATE, CURRENT, OR SUITABLE FOR ANY PARTICULAR PURPOSE. YOU ARE SOLELY RESPONSIBLE FOR VALIDATING API OUTPUTS FOR YOUR SPECIFIC USE CASE.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY NORWEGIAN LAW, GLOBAL INTECH AS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICES. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. THIS LIMITATION DOES NOT APPLY TO LIABILITY THAT CANNOT BE EXCLUDED UNDER NORWEGIAN LAW.
14. Indemnification
You agree to indemnify, defend, and hold harmless Global InTech AS and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) your content submitted to the Services.
15. Termination
By You: You may cancel your subscription at any time through your account dashboard. Cancellation takes effect at the end of the current billing period.
By Us: We may suspend or terminate your access immediately for violation of these Terms, illegal activity, or non-payment. We may terminate for convenience with 30 days notice.
Effect: Upon termination, your right to use the Services ceases immediately. Provisions that by their nature should survive termination will survive.
16. Modifications to Terms
We may modify these Terms at any time. We will provide notice of material changes via email or through our Services at least 30 days before changes take effect. Your continued use of the Services after changes become effective constitutes acceptance. If you do not agree to modified Terms, you must stop using the Services.
17. General Provisions
Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Global InTech AS regarding the Services.
Severability: If any provision is found unenforceable, the remaining provisions remain in full force.
Waiver: Our failure to enforce any right does not constitute a waiver of that right.
Assignment: You may not assign these Terms without our consent. We may assign our rights and obligations without restriction.
Force Majeure: We are not liable for delays or failures caused by circumstances beyond our reasonable control.
